Oklahoma’s New Medical Marijuana Pre-Packaging Law: What You Need to Know

If you’ve stayed up-to-date with Oklahoma’s cannabis packaging regulations, you’ve probably heard about House Bill 3361. Set to take effect on June 1st, 2025, this change in Oklahoma’s medical marijuana pre-packaging law requires all products (except concentrates) to be sold in pre-packaged quantities.
What exactly does this mean for dispensaries and medical marijuana cardholders? Let’s dive in.
What is House Bill 3361?
Signed into law in 2024, House Bill 3361 was introduced by Representative T.J. Marti and Senator Bill Coleman.
Its primary mandate? All medical marijuana flower, trim, shake, kief, and flower-based products must be sold in pre-packaged quantities between 0.5 grams and 3 ounces.
This applies to products transferred from licensed growers and processors to dispensaries. A requirement that was previously unnecessary in Oklahoma’s industry.
Why the Change?
Admittedly, lawmakers haven’t explicitly stated all their reasons. However, standardization and customer safety are at the core of this change. More specifically, pre-packaging can help with:
- Accurate dosing
- Ensuring compliance with state regulations
- Quality control
Furthermore, it moves Oklahoma’s industry closer to practices we see in other states with legalized medical marijuana programs.
How Will This Affect Patients and Dispensaries?
Patients:
- You still have the option to see and smell cannabis before purchasing. Dispensaries are still allowed to display product samples.
- The biggest shift will be that all your product purchases (except for concentrates) will come pre-packaged.
Dispensaries:
- Starting June 1st, 2025, any new inventory must be pre-packed before reaching your store.
- If you already have deli-style inventory in stock before this date, you’re allowed to continue selling it until it runs out.
- Your new inventory of pre-packaged products must be tamper-evident and sealed. However, you’re allowed to open them for display samples or to create pre-rolls.
Other Key Considerations
- Does pre-packaging need to be opaque? No. Non-opaque materials are allowed as long as they meet other state packaging and label requirements. However, once a customer makes a purchase, the product must be placed in an opaque container before it leaves your dispensary.
- Do lab testing samples need to be pre-packaged? No. The law is only applicable to medical marijuana and products transported to dispensaries.
What’s Next?
House Bill 3361 goes into effect on June 1st, 2025. However, businesses should start preparing now. The Oklahoma Medical Marijuana Authority (OMMA) is still finalizing specific regulations—so, staying up-to-date is crucial.
Final Word
Whether you’re a patient or dispensary owner, change is coming to Oklahoma’s industry. It’s important to be prepared and keep an eye on updates from OMMA to make sure you’re ready for the transition.
